PORTLAND, Ore. (KOIN) – Attorneys for Ammon Bundy filed new court documents over the weekend asking a federal judge to lift his current detention order.
A hearing over the matter is scheduled for Tuesday at the U.S. District Court in downtown Portland.
On Friday, U.S. Magistrate Judge Stacie F. Beckerman ordered that Bundy remain in custody.
Bundy’s attorney argue he should be released and that Pretrial Services could supervise him using GPS monitoring.
His attorney also suggested that, if released, Bundy would not leave Idaho, his state of residence, unless he was returning to Oregon for court appearance.
“Accordingly, Ammon Bundy respectfully requests that the magistrate’s detention order be revoked and the District Court enter an order for pretrial release with the conditions” set by Pretrial Services, according to court documents.
Bundy, according to federal prosecutors, is the leader of armed takeover of the Malheur National Wildlife Refuge. It started Jan. 2. Since then, 11 people — ihcluding Ammon Bundy and his brother Ryan Bundy — have been arrested and charged with criminal conspiracy to impede officers of the United States from discharging official duties through the use of force, intimidation, or threats.
“In this case, all defendants deliberately and publicly disregarded repeated orders, requests and pressure to obey the law over a sustained period of time,” federal prosecutors wrote in court documents.
The takeover, according to prosecutors, endangered, and continues to endanger, residents of Harney County and that the crime was not “born out of impulse.”
Tuesday’s hearing for Bundy will be before U.S. Magistrate Judge Michael W. Mosman.
Joseph O’Shaunghessy, will also appear in federal court on Tuesday, according to court records. On Friday, his attorney successfully argued for his release. Federal prosecutors will challenge the ruling. In the meantime, he remains in custody.
